Terms of Service
Last updated 22 October 2026
The short version
- The content on this website is general information, not legal advice.
- Contacting us through the website does not make you our client. That only happens once we agree in writing to act for you.
- Please do not send confidential details until we have confirmed that we can act for you.
- These terms are governed by the laws of Kenya.
1. Accepting these terms
These terms of service ("terms") apply to your use of this website, including its pages, articles and contact form. By using the website, you agree to these terms. If you do not agree, please do not use the website.
Our Privacy Policy explains how we handle personal data and forms part of these terms.
2. About us
This website is operated by Wanzau, Odhiambo & Associates Advocates ("the firm", "we", "us" or "our") of Corner House, 6th Floor, Kimathi Street, Nairobi, P.O. Box 104540-00101, Nairobi, Kenya.
Our partners are advocates of the High Court of Kenya. They are bound by the Advocates Act (Cap. 16), the rules made under it and the professional standards of the Law Society of Kenya.
3. No legal advice
The content on this website, including our articles, service descriptions and frequently asked questions, is general information about the law and our services. It is not legal advice and should not be relied on as such.
The law changes, and the right answer always depends on the facts of your situation. Before you act, or decide not to act, on anything you read here, please get advice from a qualified advocate about your specific circumstances.
4. No advocate–client relationship
Using this website, sending us a message through the contact form, or emailing, calling or messaging us does not create an advocate–client relationship between you and the firm.
We act for you only after we have checked for conflicts of interest, agreed to take on your matter, and confirmed the scope of our work and our fees in writing, usually in a letter of engagement. Our fees are guided by the Advocates (Remuneration) Order. Until then, we owe you no duty to act and we may decline to act for any reason, including a conflict of interest.
5. Contacting us and confidentiality
We treat every enquiry with discretion. However, until we have confirmed that we can act for you, information you send us may not be protected by advocate–client privilege, and we may be unable to keep it from another party whom we already represent.
For that reason, please limit your first message to your name, contact details, the names of the other people or organisations involved and a short description of what you need help with. Do not send confidential, commercially sensitive or sensitive personal information until we ask you for it.
Time limits apply to many legal claims. Sending us a message does not stop time running, and we are not responsible for any deadline that passes before we have agreed to act for you. If your matter is urgent, please call us on +254 711 529 747.
6. Using the contact form
When you use the contact form, you confirm that the information you give us is accurate and that you are entitled to share it, including any information about other people.
The contact form is protected by Google reCAPTCHA. By using the form, you also agree to Google's Terms of Service and Privacy Policy. We limit how often the form can be used, to prevent abuse.
We aim to respond to every genuine enquiry promptly, but we cannot guarantee a response time, and we do not respond to messages that are abusive, unlawful or obviously automated.
7. Acceptable use
You must not use the website:
- in any way that breaks the law of Kenya or any other applicable law, including the Computer Misuse and Cybercrimes Act, 2018;
- to send spam, unsolicited advertising or messages that are abusive, threatening, defamatory or misleading;
- to introduce viruses, malware or any other harmful code, or to try to gain unauthorised access to the website, its server or any connected system;
- to copy or collect content from the website in bulk by automated means, except for the purpose of search engine indexing;
- in any way that interferes with the website or with anyone else's use of it.
We may block access to the website, or report activity to the relevant authorities, if we believe these terms have been broken.
8. Articles and insights
Our articles reflect the law and the views of the author on the date of publication. They may not cover every aspect of a topic, and they may become out of date. We do not undertake to update articles after publication.
9. Intellectual property
The website and its content, including text, articles, images, graphics, the firm's name and logo and the design of the website, belong to the firm or to those who have licensed it to us. They are protected by the Copyright Act, 2001, the Trade Marks Act and other laws.
You may view, print and share links to pages and articles for your own personal, non-commercial use, provided you do not change them and you credit the firm. You must not otherwise copy, reproduce, republish, sell or distribute any content, or use the firm's name or logo, without our prior written permission.
10. Third-party links and services
The website contains links to other websites, such as Kenya Law and the Law Society of Kenya, and uses services provided by others, such as Google Maps and WhatsApp. We include them for your convenience. We do not control them, we are not responsible for their content or availability, and their own terms and privacy policies apply when you use them. A link does not mean that we endorse a website or its owner.
11. Availability of the website
We try to keep the website available and accurate, but we do not guarantee that it will always be available, uninterrupted or free from errors. We may change, suspend or withdraw any part of the website at any time without notice.
12. Disclaimer
The website is provided "as is" and "as available". To the fullest extent permitted by law, we make no representations or warranties, express or implied, about the website or its content, including about its accuracy, completeness or fitness for a particular purpose.
13. Limitation of liability
To the fullest extent permitted by law, the firm, its partners and staff will not be liable for any loss or damage, whether direct, indirect or consequential, arising from your use of, or inability to use, the website, or from your reliance on any of its content.
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under the law of Kenya, including your rights under the Consumer Protection Act, 2012. Our liability to clients for legal services is governed by our letter of engagement and the law, not by these terms.
14. Privacy and cookies
We handle personal data in line with the Data Protection Act, 2019. Our Privacy Policy explains what personal data we collect through the website, how we use it, the cookies we use (including Google Analytics), and your rights.
15. Governing law and disputes
These terms, and any dispute or claim arising out of or in connection with them or with your use of the website, are governed by the laws of Kenya.
If a dispute arises, please contact us first so that we can try to resolve it informally. If it cannot be resolved within 30 days, either party may refer it to mediation. If mediation does not resolve the dispute, the courts of Kenya will have exclusive jurisdiction.
16. Changes to these terms
We may update these terms from time to time. The "last updated" date at the top of this page shows when they were last revised. The version published on the website when you use it is the version that applies, so please check this page from time to time.
